My HONOR User Agreement

1 About Us
The My HONOR app (hereinafter referred to as "My HONOR", "the App", or "this App") is provided, operated, and maintained by HONOR INFORMATION TECHNOLOGY CO., LIMITED, a company incorporated in Hong Kong, China, whose registered address is at 29-130 Room, 29-30F, Tower 5, The Gateway, No. 15 Canton Road, Tsim Sha Tsui, Kowloon, Hong Kong. and whose registered number is 2998419 (hereinafter referred to as "we", "our", "us", or "HONOR"). In this Agreement (as defined below), "you" and "user" refer to any individual that uses and/or accesses the App.
2 This Agreement
2.1 This user agreement, our privacy statement and other policies and information published or made available through the App (collectively, this "Agreement") are the terms and conditions applicable to you regarding your use of, and access to the App. This Agreement tells you who we are, what services and how we will provide services to you, what activities are permitted or not permitted, by or in connection with the App, what to do if there is a service issue, and other important information.
2.2 Please read this Agreement carefully, especially the clauses about exclusion or limitation of liability and those about governing laws and dispute resolution and such clauses will be written in bold or capital letters to draw your attention and you are supposed to review them with particular care.
2.3 By using the App, you agree to this Agreement and enter into a binding legal agreement with us. Your use of the App and the functions provided to you within the scope of the App shall only be admissible subject to your prior acceptance of the Terms. IF YOU DO NOT AGREE WITH ANY OF THE TERMS, PLEASE DO NOT USE THE APP.
3 Changes to This Agreement
3.1 Honor is constantly updating, changing, and improving the App. Honor may add or remove functions or features, create new limits to the App, or temporarily or permanently suspend or stop the App. Honor may also modify this Agreement at any time based on updates to the App.
3.2 Honor will inform you within a reasonable period of any changes to the App or this Agreement that will materially disadvantage users or materially limit their access to or use of the App. Please check this Agreement periodically for changes. Your continued use of the APP following the posting of changes will mean that you accept and agree to the changes. Should you object to any changes to this Agreement, you must immediately stop using the APP. For changes to the App that we need to make to meet security, safety, legal, or regulatory requirements, we may not be able to meet the aforementioned timescales and we will update you about these changes as soon as is practicable.
4 Other Terms that May Apply
Additional terms and conditions may apply to the provision of our goods or services, including events, promotions or other similar features, and to specific portions or features of the APP, all of which terms are made a part of this Agreement by reference. You agree to abide by such other terms and conditions. If there is a conflict between these Website Terms and the terms posted for or applicable to a specific portion of the APP, or for any service offered on or through the APP, the latter terms shall prevail with respect to your use of that portion of the APP or the specific service.
5 Eligibility
You must be 18 years of age or older, or have reached the age of majority for the legal jurisdiction that you reside in to access and use any of the App. If you are under the age of 18 years, your parent or guardian must agree to the terms of this Agreement on your behalf in order for you to use the App. If you do not meet the preceding requirements, we will not be allowed to provide the App to you, and you should compensate us for any losses incurred or any third parties due to you using the App.
6 Access to the App

6.2 Using this App to post, comment, follow, like, bookmark, check in and other functions may require your prior registration, including setting up your HONOR ID or third-party Account ID (Google ID), if you do not already have one. You will therefore have to acknowledge terms of use and privacy policy of the third-party Account if you use a third-party Account ID.
6.3 If you choose, or you are provided with a user identification code, password, or any other information as part of our security procedures, you must keep such information secret and confidential. You must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us at any time, if, in our reasonable opinion, you have failed to comply with any provisions of these website terms. If you know or suspect that someone other than you know your user identification code or password.
7 My HONOR APP Services
7.1 Basic services and functions
My HONOR application ("the Application" or "this Application"), which you can visit to get latest news and updates of Honor phones, apps, themes, reviews, tutorials.
7.2 Availability
Honor has always prioritized consumers and providing quality services. However, Honor may not be able to guarantee that all services can operate non-disruptively and/or flawlessly at any time due to reasons beyond our control. This is because certain countries and regions lack the necessary environments and conditions for the provision of some services. In such cases, the App may not be able to operate properly. For example, booking Postal repair services online or making in-store repair appointments may not be available in some countries and regions. Honor reserves the right to modify, remove, restrict, prevent access to, or stop providing all or any part of the App at its own reasonable discretion without prior notice.
7.3 HONOR CLUB
7.3.1 In the CLUB section, you can share how you feel and what you learn during your use of Honor devices or services, and communicate with other users to resolve issues.
7.3.2 You may not use CLUB in any manner that may cause interruption or encumbrance to access CLUB. If your actions do or may interfere with CLUB, Honor reserves the right to take actions against your account. You may temporarily or permanently stop accessing CLUB at any time, and Honor may impose restrictions on the time during which and the manner in which any part of CLUB or its content may be used for any reason without notice.
7.3.3 Content in the CLUB is for reference only. Honor makes every effort to ensure the correctness of information and materials in the CLUB, but makes no warranty or commitment, express or implied, in connection with their completeness, accuracy, or currentness. To the extent permitted by law, Honor shall not be liable for any errors or omissions therein.
7.3.4 In posting any content in the CLUB, you shall comply with the provisions of this Agreement on user content, including but not limited to the "Your Content" section of this Agreement.
7.3.5 Honor may offer you benefits and rewards for your participation in CLUB. These benefits and rewards are subject to additional CLUB guidelines, terms, and conditions, which are posted in CLUB. The benefits and rewards provided do not however create any relationship of employment, agency, or independent contractor between you and us, and you may not present yourself as a spokesperson for Honor.
These Additional terms concerning the CLUB section shall be without prejudice to the terms of use for CLUB and in the event of any inconsistency, the terms of use for CLUB shall prevail.
8 Account Security
8.1 You must keep your Honor ID or third-party Account ID (Google ID) username and password (hereinafter collectively referred to as "Account Information") secret and confidential, and you must not share them with anyone else. We recommend that you choose a strong password and keep it in a safe place. You are responsible for keeping your password safe and assume all liability for damage or loss suffered as a result of disclosure your Account Information to a third party.
8.2 If you think that someone else might be using your Account Information, you should let us know immediately using the contact information provided in the "Contact Us" section. You must not use another person’s HONOR ID to access the App. You must take appropriate steps to protect your Account Information to prevent unauthorized use by third parties.
9 Intellectual Property
9.1 Honor the owner or the licensee of all intellectual property rights on this App, and of all material published on it, including but not limited to texts, images, music, videos, animations, trademarks, patterns, charts, visual interfaces and code, which are protected by various intellectual property laws and treaties around the world. All such rights are reserved. Your access to and/or use of any of the App does not transfer to you or any other person any ownership or other rights in or to the App, or their content, unless otherwise specified in this Agreement.
9.2 You must not use any part of the content on the App for commercial purposes without obtaining a prior license to do so from us or our licensors.
9.3 You may not make alterations, copies, extractions, modifications or additions to the App, or sell, copy, disseminate, license, or misuse the App in any way. If you want to re-publish, extract, reproduce, disseminate, or otherwise use any content of the App, you must contact Honor in advance and obtain Honor's prior written consent unless otherwise expressly provided in this Agreement. This is without prejudice to any rights you may have under applicable mandatory laws.
9.4 Any use other than in accordance with the Website Terms is prohibited. If you breach any of the Website Terms, your permission to use the App automatically terminates and you must immediately destroy any downloaded or printed materials from the App.
9.5 If you believe that the App or any part thereof infringes upon any copyright, trademark, patent, trade secret or other intellectual property right, or if you have other concerns regarding the App, please notify us using the contact information provided in the "Contact Us" section.
10 Your Content
10.1 HONOR do not claim any proprietary rights to the text, files, images, photos or any other information you upload, post, or otherwise transmit to or through the App (collectively "Your Content"). You continue to retain ownership and are entirely responsible for Your Content.
10.2 Subject to applicable laws, you hereby grant us an irrevocable, royalty-free, worldwide, transferable, and sublicensable license to use any material or information you submit on the App for the purpose of general marketing communication by any means and through any media.
10.3 Your Content shall not be anything that is illegal, obscene, abusive, threatening, slanderous, offensive, inaccurate, invasive of privacy or intellectual property rights, or otherwise detrimental to a third party and shall not contain software viruses or spam in any form. Your Content does not operate to instruct or suggest any breach of regulations or laws in any manner. Honor does not assume any liability arising from the reference to or use of Your Content by any person who accesses the App or knows Your Content.
10.4 Honor does not control or screen Your Content and therefore does not guarantee the accuracy, completeness, or currentness of any Your Content. Nevertheless, Honor reserves the right to pre-screen, filter, restrict, block, move, reject, modify, or delete Your Content at any time without prior notice. You may report any inappropriate content to Honor and Honor may take appropriate action in response.
11 Your Obligations
11.1 You undertake to abide, at all times, by the Website Terms and all applicable laws. You may not misuse any "hacking", "deep-link", "page-scrape", "robot", "spider" or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the App or its content, or in any way reproduce or circumvent the navigational structure or presentation of the App or its content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the App.
11.2 Honor reserves the right to bar any such activities. You must not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the App or our systems or networks, or any systems or networks connected to the App or to Honor.
11.3 By accessing and using the App, you undertake and agree to do so in a legal and ethical manner and in accordance with this Agreement. You hereby acknowledge and agree that you shall not use the App to transmit material, or otherwise engage in any activity that is dishonest, defamatory, tortious, harmful, obscene, offensive, bullying, harassing, scandalous, hateful, inflammatory, threatening, unlawful, profane, pornographic, invasive of privacy, or otherwise objectionable in relation to your use of the App including without limitation, anything that facilitates illegal activities, depicts sexually explicit images, promotes violence, is discriminatory, illegal, could or does cause damage or injury to any person or property, or could give rise to any civil or criminal liability under applicable laws, including, without limitation, any material that you are not entitled to post or transmit, or where such posting or transmission is in breach of any duty of confidentiality and/or infringes upon third-party intellectual property rights.
11.4 You hereby agree and undertake:
(1) Not to reproduce, make alterations to, or modifications of, the whole or any part of the App, or permit the App or any part of them to be combined with, or become incorporated in, any other programs;
(2) Not to gain or attempt to gain unauthorized access to or impair any aspect of the App or their related systems or networks;
(3) Not to disassemble, decompile, reverse-engineer or create derivative works based on the whole or any part of the App, or attempt to do so beyond the extent allowed by applicable laws;
(4) Not to distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the App;
(5) Not to provide or otherwise make available the App in whole or in part (including the object and source code), in any form to any person without our prior written consent;
(6) Not to impersonate any person or falsely state or otherwise misrepresent your affiliation with a person or entity;
(7) Not to use the App (or any part(s) thereof) in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with this Agreement, or act fraudulently or maliciously, including without limitation, by inserting malicious code, including viruses, or harmful data, into the App (or into the websites linked to the App) or any operating system;
(8) Not to infringe upon our intellectual property rights or those of any third party in relation to your access to and/or use of the App;
(9) Not to collect users' information, or otherwise access the App or our systems, using automated means or attempt to decipher any transmissions to or from the servers running the App;
(10) Not to commercially exploit the App without our prior written consent;
(11) Not to use the App to engage in any illegal business transactions, such as selling firearms, drugs, illegal substances, pirated software or other prohibited items;
(12) Not to provide gambling information or encourage others to gamble through any means;
(13) Not to solicit login information or access an account belonging to someone else; (o) Not to engage in money laundering, illegal cash advances, or pyramid selling schemes;
(14) Not to attempt, facilitate, or encourage any violations of this Agreement (or any part(s) thereof); and
(15) Not to use the App in any manner which could damage, disable, impair or compromise the App, our systems, or security, or interfere with other users or any other party's computer systems or hack or gain unauthorized access to the App or data.
11.5 Honor may at all times, subject to Honor’s sole discretion, block, delete or modify such contributions that are in violation of your above obligations, block or delete your Membership, and/or cancel/block your access entirely.
11.6 You are responsible for maintaining, at your own expense, an adequate Internet connection which is a requirement to use the APP.
12 Monitoring
You acknowledge and agree that, in accordance with applicable laws and regulations, we may at any time, at our sole discretion and without notice to you, take such measures as we decide are necessary for the purposes of operating and improving the App (including without limitation for fraud prevention, risk assessment, investigation and customer support purposes), ensuring your compliance with this Agreement, applicable laws, orders or directions of any court, consent decree, administrative agency, or other governmental body.
13 Privacy
We will only collect and process your personal information as set out in our Privacy Statement.
14 Disclaimer and Limitation of Liability
14.1 The App are for your sole use only and must not be used by any third party. You agree that Honor and its affiliates, officers, directors, employees, contractors, agents, third-party payment providers, partners, licensors and distributors (collectively "Honor Parties") are not liable for any losses caused by any unauthorized use of the App.
14.2 Your use of the App may be interrupted, delayed, or disrupted for an unknown period of time for reasons that are beyond our control. The Honor Parties will not be liable for any claim arising from or related to such interruptions, delays, disruptions or similar failures.
14.3 To the maximum extent permitted by applicable laws, the Honor Parties are not liable to you or to anyone else for any damages if you or anyone else are unable to access or use the App due to:
(1) Any suspension or termination of the App by Honor to enable maintenance work or updates to systems, software or hardware to be carried out;
(2) Any delay or failure of a system or communication network that is owned or controlled by someone other than Honor;
(3) Any suspension, cancellation or termination of any contract or other arrangements between Honor and any of its third-party service providers that affect the App;
(4) Any errors or interruptions due to hacking attempts or similar security breaches; or
(5) Any other event or occurrence beyond Honor's reasonable control.
14.4 The App is provided on an "as-is" and "as-available" basis without any representation or endorsement of any kind. To the maximum extent permitted by applicable laws in your jurisdiction, the Honor Parties disclaim all warranties, conditions, or other terms of any kind, express or implied, and make no guarantee, undertaking, representation, or warranty for the following:
(1) Any defects of the App will be corrected;
(2) Your use of the App will provide specific results;
(3) Any files or data you download from the App will be free of viruses or contamination or harmful features
(4) The completeness, accuracy, reliability or timeliness of any of the content made available on or through the App;
14.5 The Honor Parties are not liable for any losses or damages to you caused in whole or in part by you relying upon, using, or interpreting the App or other information obtained through your (or any other person's) access to and/or use of the App.
14.6 All information provided on the App is subject to change without notice.
14.7 The Honor Parties are not liable for the acts, omissions, and conduct of any third parties in connection with or related to your use of the app and/or any honor services.
14.8 You assume total responsibility for your use of the App and any linked apps. Your sole remedy against honor for dissatisfaction with the App or any content is to stop using the App or any such content. This limitation of relief is a part of the agreement between the relevant parties.
14.9 To the extent permitted by law, the above disclaimer applies to any damages, liability or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction of or unauthorized access to, alteration of, or use, whether for breach of contract, tort, negligence or any other cause of action.
14.10 Except where prohibited by law, in no event will Honor be liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including, but not limited to, lost profits and damages caused by your negligent breach of confidentiality obligations, even if Honor has been advised of the possibility of such damages.
14.11 The laws of some countries do not allow liability in relation to certain warranties, undertakings, representations, or guarantees to be excluded or limited by a contract. If these laws apply to you, some or all of the above exclusions or limitations may not apply to you. Nothing in these Website Terms affects the rights that you are legally entitled to as a consumer, or which you cannot contractually agree to alter or waive.

The App or third parties may provide links to other websites or resources. You acknowledge and agree that these links are provided for your reference only and Honor will not be responsible for the availability of such external websites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such websites or resources. You further acknowledge and agree that we are not responsible or liable, directly or indirectly, for any damages or losses caused or alleged to be caused by or in connection with your use of or reliance on any such content, goods or App available on or through any such websites or resources. We suggest that you carefully review the privacy policy and terms of use issued by respective entities.
16 Termination
16.1 You can terminate this Agreement via your account settings or by ceasing to use the App.
16.2 Subject to applicable laws, Honor may temporarily or permanently suspend, cancel, impose limits on, or restrict your access to part(s) or all of the App at any time, without assuming liability for any individual or third party. We will endeavor to provide notice to you before we do this. However, we may not provide prior notice to you, and may immediately, permanently, or temporarily, impose limits on, cancel, suspend, or restrict your access to parts or all of the App service under the following circumstances:
(1) If you violate, or Honor believes that you are about to violate, this Agreement, including any agreements, policies, or guidelines incorporated herein;
(2) If you, or anyone acting on your behalf, acts fraudulently or illegally, or provides Honor with any false or misleading information;
(3) In response to requests by law enforcement or other government agencies under valid legal process;
(4) In case of urgent maintenance work or urgent updates to systems or hardware; or
(5) Due to unexpected technical, safety, business, or security reasons.
16.3 The expiry or termination of this Agreement does not affect the provisions of this Agreement that are expressed to operate or have effect after the expiry or termination thereof, and is without prejudice to any accrued rights or obligations or any rights or obligations which are intended to survive such expiry or termination.
16.4 Any provisions of this Agreement which expressly or by their nature are intended to survive the termination of this Agreement shall remain in full force and effect subsequent to and notwithstanding such termination, until such provisions are satisfied or expire due to their natures.
17 Governing Laws and Jurisdiction
The formation, interpretation and, operation of this Agreement are governed by and construed in accordance with the laws of Hong Kong. You and Honor agree that this Agreement is signed in Hong Kong. Any claims or disputes arising from this Agreement shall be settled through negotiation. If the negotiation fails, either party shall file a lawsuit with the court of Hong Kong.
18 Miscellaneous
18.1 Nothing in this Agreement shall be construed to create a partnership or agency relationship between you and Honor, and neither party shall have the right or authority to incur any liability, debt, or cost, or enter into any contracts or other arrangements in the name of or on behalf of the other.
18.2 Honor is not liable for any failure or delay in the performance of its obligations under this Agreement or the provision of the App that is caused by or attributed to matters beyond Honor's reasonable control.
18.3 Honor may assign, sub-contract or novate any of our rights and/or obligations under this Agreement.
18.4 If any provision (or part of a provision) of this Agreement is found by a court of competent jurisdiction or any other competent authorities to be void, invalid, or unenforceable, it shall be deemed to be deleted from this Agreement and all other provisions of this Agreement shall remain in full force and legally effective.
